Maryland FAMLI: What Employers Need to Know as Implementation Moves Forward

Maryland’s Family and Medical Leave Insurance (FAMLI) program is moving closer to full implementation, and many employers—especially small and mid-sized businesses, are still working to understand what it means for their teams, operations, and compliance responsibilities. As contribution and benefit dates approach, HR professionals and business leaders should get familiar with the core elements of FAMLI and begin planning now for a smoother transition.

At HR Matters Today, we’ve been following FAMLI developments closely. This post breaks down the essentials employers should understand now so they can prepare their policies, payroll processes, and employee communications.

Puzzle outlineWhat Is Maryland FAMLI?

Implementation timelines and guidance may continue to evolve, so employers should confirm the latest requirements with the Maryland Department of Labor before making payroll, policy, or employee communication changes.

Maryland’s Family and Medical Leave Insurance program is a statewide initiative designed to provide paid leave benefits to eligible workers who need time away from work for major life events. These include:

  • Bonding with a new child
  • Caring for a seriously ill family member
  • Managing a personal serious health condition
  • Addressing certain military‑related needs

FAMLI is structured so that both employers and employees contribute to a state-managed fund that pays out benefits when qualifying leave is needed.

Puzzle outlineWho Is Covered?

Most Maryland employers, regardless of size, will be included in the program. Employees who meet the program’s minimum work and earnings thresholds will be eligible for benefits. Even very small employers may have responsibilities under FAMLI, so it is important to understand how the rules apply to your organization.

Federal employees who work in Maryland will not be eligible for FAMLI benefits and will not contribute to the fund.

Puzzle outlineImportant Dates

January 1, 2027 – contributions are scheduled to begin.

2. Review your current leave policies.

Compare your existing leave policies with FAMLI requirements so you can identify overlaps, gaps, and areas that may need updates before contributions and benefits begin.

3. Prepare your payroll provider.

Confirm that your payroll provider is tracking FAMLI updates and will be ready to support contribution calculations, reporting, and employee deductions when required.

4. Communicate early.

Employees will have questions. Sharing what you know—even at a high level—builds trust and reduces confusion.
